ByteForge Tech Limited User Agreement
(hereinafter referred to as "ByteForge," "this Service," "the Company," or "we")

This Agreement is a joint agreement between ByteForge Tech Limited and general users (referring to users who have not registered as members, hereinafter referred to as "users," "general users," or "you") and registered members (hereinafter referred to as "members" or "you").

You should regularly review the latest version of this Agreement. ByteForge may modify or amend this Agreement and related policies at its sole discretion at any time. If you continue to use this service, you agree to be bound by the above modifications or amendments.

Eligibility

To use our services, you must be at least 18 years old. If you are under 18 years old, your legal guardian must register for this service on your behalf and accompany you throughout the use of this service. Before using this service, your legal guardian must read, understand, and agree to the content of this Agreement and any subsequent amendments, and provide their consent. Only then may you register or use this service. By using this service, it is deemed that your legal guardian has read, understood, and agreed to the content of this Agreement and any subsequent modifications.

If you do not agree to any part of this Agreement, please stop using this service.

1. Service Overview

ByteForge is a service platform that provides members with online influencer recommendations and matching services. This platform includes, but is not limited to: all products, software, services, websites, mobile applications (APP), and other applications provided through the ByteForge website. Members can perform influencer data searches, influencer recommendations, and influencer matching services after free or paid registration.

2. Data Storage and Space

Unless paid members apply for additional paid services, ByteForge reserves the right to add or modify storage space size.

ByteForge will regularly back up the data you store; however, ByteForge is not responsible for deleted data or failed backup storage.

This system does not guarantee that the data you upload will be displayed normally or that data transmission will be accurate. If you find any errors or omissions in this system, please notify ByteForge immediately.

3. Provision of This Service

Once you complete the registration process at ByteForge and the Company completes the setup, you will obtain the qualification of a Company member and can start using the member functions of this service. General users may use limited service content as "visitors."

If you do not log in to use this service for 180 consecutive days, you agree and understand that the Company has the right to suspend your access to all free services and may delete all data you have stored on this service. Your login records will be based on the records retained in the Company's system.

The Company reserves the right to add, change, or cancel all or part of the service system or functions. You understand and agree that relevant cancellations or changes to service content will be announced on the service platform, and we do not need to notify you individually.

If the Company sets other usage rules or agreements for individual activities, you must also comply with the usage rules and related regulations of each activity. If the usage rules or agreements of any activity conflict with this Agreement, the Company reserves the final right to interpret and apply the rules.

You understand and agree that if this service requires or includes downloadable software, the software may automatically update on your device when a new version or feature is provided. However, you can adjust the automatic update settings based on your device.

You agree that ByteForge may send announcements or commercial messages of this service to your email, computer, or mobile device.

4. Data Privacy

ByteForge will protect the privacy of all members in accordance with the Privacy Policy. Unless it involves illegal activities, infringement, violation of service terms, or consent from the user, ByteForge will not arbitrarily monitor, add, delete, modify, or close personal data or provide it to third parties, including sponsored advertisers.

If part of the member services is co-operated by ByteForge and other partners, and if you do not wish to disclose your personal data to these partners, you may choose not to use these specific services. However, if you start using these specific services, it is deemed that you agree to provide your personal data to the partners of these specific services. ByteForge will clearly inform you before collecting or transmitting your personal data.

You agree that ByteForge may view or provide your personal data to courts, authorities, or third parties with appropriate proof of infringement of their rights under the following circumstances:
(1) As required by law or judicial administrative orders;
(2) To enforce the terms of this member service;
(3) To maintain the normal operation and security of the member service system;
(4) To protect the legal rights and interests of other users or third parties.

5. Paid Services

You understand and agree that if you wish to use the Company's paid services, you must pay the Company or a third-party company cooperating with the Company.

The Company has independent decision-making power over the billing standards for paid services. The billing method will take effect after the Company's announcement, and you must comply with it.

The Company reserves the right to add or change service fees. However, if the increase in service fees affects the existing rights and interests of members, the Company will announce it one month in advance and notify you via email.

6. Intellectual Property Considerations

You guarantee that the content you post or upload through this service, including but not limited to sound, images, videos, text, software, scripts, graphics, photos, music, audiovisual combinations, interactive functions, and other materials (hereinafter referred to as "Content"), does not infringe on the copyright, patent, trademark, trade secret, or other proprietary rights of third parties (hereinafter collectively referred to as "Intellectual Property Rights").

If the intellectual property rights involved in the content you upload are not owned by you, you guarantee that you have obtained the permission of the legal owner of the content when uploading and have the right to further grant ByteForge to use it on this service platform. However, the Company is not obligated to post or use the content you submit and may remove any submitted content at any time. The Company is not responsible for the content you post or upload to this service platform.

If the Company is claimed by a third party to have infringed its rights due to the content you post or upload to this service platform, the Company may immediately remove the aforementioned submitted content. If the Company suffers damage as a result, you shall be responsible for compensating the Company for the damage (including but not limited to litigation costs and attorney fees).

7. Advertising on ByteForge Website Member Services

ByteForge owns all rights and advertising space management rights on all pages of the website, including but not limited to banner ads, pop-up ads, or other forms of ads and messages appearing at the top of the webpage or other positions deemed appropriate by ByteForge. Unless prior consent is obtained from ByteForge, members or third parties may not sell, manage, or provide such online advertising or similar services to third parties in any way. However, members' personal blog page spaces are not subject to this restriction.

All advertisements appearing on the ByteForge website are the sole responsibility of the respective advertisers or sponsors and are not related to ByteForge.

8. User Conduct Restrictions

You must comply with relevant laws and regulations and agree not to engage in the following behaviors:
(1) Post, transmit, send, or store any defamatory, fraudulent, harmful, obscene, pornographic, gambling, abusive, false, or other illegal files or data.
(2) Post, transmit, send, or store any data that infringes on the intellectual property rights or other rights of others.
(3) Unauthorized extraction or use of all or part of the database content within the member services.
(4) Post, transmit, send, or store viruses or any programs or messages that may damage or interfere with computer systems or data.
(5) Disrupt or interfere with the operation of the member service system or violate general internet etiquette.
(6) Unauthorized access to the member service system or impersonation of another user's account or falsification of identification data.
(7) Any theft of member service accounts, passwords, or access permissions.
(8) Any behavior that hinders or interferes with other users' use of member services.
(9) Any behavior that does not comply with the intended use of the member services.
(10) Disrupt or interfere with the data, activities, or functions provided by this service, or attempt to invade or damage any system of this service.
(11) Engage in illegal transactions or post messages or conduct transactions that incite criminal behavior.

The text, images, pictures, and other works or data within the member services are owned by the legal rights holders and are licensed to members under the terms and scope of the license at the time. However, you may only use these materials personally on the ByteForge website. Without prior authorization, you may not reproduce, publicly recite, broadcast, perform, transmit, adapt, distribute, publish, sell, transfer, rent, lend, sublicense, or use these materials in any other form, nor may you upload them to other websites or provide them to others in any other way.

ByteForge does not conduct any formal or substantive review of the content transmitted, posted, or published by members. If any text, images, pictures, or other works or data are disputed in terms of ownership or legality, ByteForge has the right to stop providing member services or delete such content without notice, or notify members to stop using member services.

If you believe that any content on the ByteForge website or any member's use of ByteForge website services infringes your copyright, please contact customer service, who will handle the matter promptly.

If any pornographic, insulting, defamatory, or other non-compliant images are found, ByteForge will immediately delete them and terminate the account without further notice.

9. Restrictions on Specific Types of Partnership Businesses

To protect the rights and interests of all users and comply with relevant laws and regulations in different regions, we have established guidelines for restricting advertisements from certain industries. Please read carefully and strictly adhere to these guidelines before engaging in any form of partnership promotion.

Promotion of any goods or services that violate national laws and regulations is not allowed, including but not limited to drugs, controlled knives, counterfeit goods, etc.

Avoid promoting products related to politically sensitive, religious, or other controversial topics, especially when such content may lead to social instability.

It is strictly forbidden to promote goods or services unsuitable for minors' age groups, such as alcoholic beverages, tobacco products, and adult items.

Advertisements must not include unauthorized use of others' personal information and should not encourage the collection, storage, or sharing of personal sensitive data without consent.

It is prohibited to attract attention or promote products through content containing pornography, violence, or other inappropriate public discussions.

For medicines, medical devices, and other health-related products, stricter review standards should be followed to ensure that advertisement content is truthful, reliable, and complies with local health department regulations.

When promoting financial investment products, full disclosure of risk warnings is required to avoid exaggerating expected returns and misleading consumers into making irrational decisions.

10. Limitation of Liability

For all member services provided by ByteForge, they are provided for use based on the functions and current status of the service at the time. ByteForge does not provide any form or content of guarantee or warranty for specific requirements or needs of users, including but not limited to speed, security, reliability, integrity, accuracy, and uninterrupted or error-free operation.

For the images or text you upload, you should judge whether it is appropriate to publicly transmit them to the website. ByteForge will make every effort to ensure the security of your data but cannot guarantee the reliability or accuracy of any file or data during transmission, nor can it guarantee the security, reliability, integrity, accuracy, or uninterrupted or error-free operation of stored files or data.

For emails, files, and other data you download through this service, you should consider the risks yourself. If downloading causes damage to your computer system or loss of data, ByteForge is not responsible. In this service, the information, data, text, software, music, audio, photos, graphics, videos, messages, or other materials uploaded, publicly transmitted, published, or privately sent by you and other members (hereinafter referred to as "User Content") are the sole responsibility of the provider of the "User Content." This service cannot control the "User Content" posted through this service and therefore does not guarantee its accuracy, completeness, or quality. You understand that using this service may expose you to unpleasant or offensive "User Content." In any case, ByteForge is not responsible for any "User Content," including but not limited to any errors or omissions, and any loss or damage arising from the posting, emailing, or transmission of such content through this service.

11. Service Suspension or Interruption

For "routine" maintenance, relocation, or changes to certain member service functions that result in service suspension or interruption, ByteForge will notify members via email, announcement, or other appropriate means before the suspension or interruption. You agree that ByteForge is not liable for any damages.

In the following circumstances, ByteForge will suspend or interrupt all or part of this service and is not liable for any direct or indirect damages to users:
(1) When relocating, replacing, upgrading, maintaining, or repairing the hardware or software equipment related to this service;
(2) When users violate government laws or the terms of this service;
(3) When service is stopped or interrupted due to natural disasters or other force majeure events;
(4) When service is stopped or interrupted due to any reasons not attributable to ByteForge.

If the service is stopped due to reasons attributable to ByteForge, ByteForge will compensate paid members for the days of use based on the circumstances.

12. Termination of Service

Based on the Company's operations, member services may be stopped in whole or in part, and users may not claim any compensation or damages as a result.

If you violate the terms of this service, ByteForge reserves the right to temporarily suspend or terminate the provision of services at any time, and you may not claim any compensation or damages as a result.

You agree that if any files or data you post, transmit, send, or store on the member services violate laws, violate the terms of this service, or infringe on the rights of third parties, ByteForge may, without notice, remove, delete, or stop providing services and is not liable for damages. If ByteForge suffers any damage as a result, you shall be liable for compensating ByteForge.

13. Right to Modify Service Terms

ByteForge reserves the right to modify the terms of this member service at any time. The modified terms will be published on the KOL Agent website. You agree to proactively read the modified terms, and ByteForge will not notify users individually.

If any part of the terms of this Agreement is deemed invalid, it does not affect the validity of the remaining terms.

14. Miscellaneous

The headings in this Agreement are for reference only and do not affect the interpretation, explanation, or understanding of the relevant terms.

If any part of the terms of this Agreement is deemed invalid by a judicial authority, it does not affect the validity of the remaining terms. Before the Company modifies the invalid terms, they shall be handled in accordance with the relevant laws of the State of Nevada, USA.

The interpretation and application of this Agreement shall be governed by the laws of the State of Nevada, USA. Members agree that any disputes arising from this Agreement shall be subject to the jurisdiction of the courts of the State of Nevada, USA, unless otherwise provided by law.
